The legislature passed H. B. 1831 which adopts a 2% E-911 fee, collected by the retailer, on the retail purchase price of prepaid wireless telecommunications services. “Prepaid wireless telecommunications services” include prepaid cell phones sold at retail stores. The Comptroller is currently in litigation with multiple providers of prepaid wireless telecommunications services; in the litigation the Comptroller argues that the preparid service providers owe the same E-911 fee that non-prepaid service providers owe on their services. Non-prepaid service providers are required to collect the fee from their customers on the customers’ monthly invoices. Prepaid service providers argue that they are not required to pay this fee because they do not send monthly invoices to their customers. If signed by the Governor, the new E-911 fee on prepaid services would go into effect on June 1, 2010.
