Our firm assists clients with data center development. Our work includes helping identify a suitable location, securing the real estate rights for the facility (land purchase contracts and options, leases, and easements), and drafting documents necessary for ancillary rights, including accommodation agreements and agreements to allow for co-location of data centers with future or existing generation projects. Our experience also includes advising clients on required state regulatory filings and approvals, helping clients navigate state and local permitting requirements, including any county and municipal regulations, issuing opinion letters to support project transactions including advising on applicable provisions in the construction loan financing agreements, equity capital contribution agreements, and membership interest purchase agreements. Our experience also includes assistance with property tax abatement agreements and Texas sales tax issues.
